International Orders Shipping Policy
At Command Elite Hobbies Pty Ltd ("we," "us," "our"), we are committed to facilitating international sales while ensuring full compliance with export and import regulations. By placing an international order, you, the customer ("you" or "your"), agree to the following conditions:
1. Export Facilitation
1.1. Command Elite Hobbies will liaise with freight carriers and facilitate the export of all international orders to the shipping address provided at checkout.
1.2. Orders will not be shipped until all necessary documentation has been completed and cleared for export.
2. Buyerโs Legal Responsibilities
2.1. The Buyer is solely responsible for:
- Obtaining any import permits, licences, or applications required for entry into their country of destination;
- Ensuring compliance with all laws and regulations governing the import, possession, or use of the purchased items; and
- Paying all import duties, customs charges, VAT, GST, tariffs, brokerage fees, or other associated costs levied by the destination country.
2.2. The Buyer confirms that all legal checks and requirements have been made in their country of origin or shipping destination prior to completing their purchase.
2.3. Any seizure, confiscation, or refusal of entry by customs or government authorities is the sole responsibility of the Buyer. Command Elite Hobbies will not issue refunds or replacements in such circumstances.
3. Accuracy of Information
3.1. The Buyer must provide complete and accurate shipping details, including name, address, phone number, and email.
3.2. Command Elite Hobbies is not liable for delays, losses, or undeliverable shipments caused by inaccurate or incomplete information provided by the Buyer.
4. Customs Clearance and Delays
4.1. Customs clearance times vary by country and are outside the control of Command Elite Hobbies.
4.2. The Buyer acknowledges that delays caused by customs inspections, documentation requirements, or local regulations do not constitute grounds for cancellation or refund.
4.3. If additional documentation or permits are required after dispatch, it is the Buyerโs responsibility to provide these promptly to their local customs authority.
5. Refused or Returned Shipments
5.1. If a shipment is refused, abandoned, or returned due to non-payment of duties, lack of required permits, or any other reason, the Buyer remains liable for all costs, including return freight, handling, and any associated fees.
5.2. Refunds for returned shipments will only be processed once the goods are received back by Command Elite Hobbies in their original condition, less any costs incurred.
5.3. No refund will be issued if the goods are confiscated or destroyed by customs or local authorities.
6. Restricted and Prohibited Goods
6.1. Certain countries may classify gel blasters, knives, or related products as restricted or prohibited. It is the Buyerโs responsibility to verify local import laws before placing an order.
6.2. Command Elite Hobbies does not provide legal advice and cannot guarantee the legality of products in the Buyerโs country. Customers are strongly advised to consult local authorities or legal advisors prior to purchase.
7. Insurance and Liability
7.1. Paid postage options include insurance for goods up to AUD $100. Additional insurance may be purchased at checkout for higher-value orders.
7.2. Liability for goods transfers to the Buyer once the order is handed to the shipping carrier, except where additional insurance has been purchased.
7.3. In cases of loss, damage, seizure, or confiscation beyond our control, Command Elite Hobbies bears no liability and no refund will be provided.
7.4. Command Elite Hobbiesโ total liability in any claim is strictly limited to the purchase price of the goods, excluding consequential or indirect losses.
8. Force Majeure
8.1. Command Elite Hobbies shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to: natural disasters, government actions, customs strikes, war, terrorism, pandemics, carrier delays, or other unforeseen circumstances.
9. Governing Law & Jurisdiction
9.1. All international sales are governed by the laws of Queensland, Australia.
9.2. By placing an international order, the Buyer agrees that any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
10. Agreement
By placing an international order with Command Elite Hobbies, the Buyer acknowledges and agrees that:
- They have conducted all necessary legal checks regarding importation into their country;
- They accept full liability for customs clearance, import fees, and compliance with local laws;
- They understand that Command Elite Hobbies is not responsible for delays, seizures, or penalties arising from non-compliance with the laws of the destination country; and
- They agree to the limitations of liability outlined in this policy.
